According to Article 182 of the Labor Code of the Republic of Kazakhstan No. 414-V of November 23, 2015, the Employer is obliged to carry out the following measures in the field of occupational safety and health:
Assess professional risk and take measures to minimize and eliminate it, through preventive actions, replacing production equipment and technological processes with safer alternatives;
Conduct training, instruction, and knowledge checks for employees on safety and labor protection issues, and ensure that documents for safe production processes and work are provided at the employer’s expense;
Organize training and knowledge checks on safety and labor protection issues for managers and persons responsible for safety and labor protection, periodically, at least once every three years, at organizations providing professional development, according to the procedure defined by the authorized state labor authority, based on a list approved by the employer's act;
Create necessary sanitary and hygienic conditions for employees, provide and repair special clothing and footwear, supply them with preventive treatment agents, washing and disinfecting agents, medical kits, milk or equivalent food products, and/or specialized products for dietary (therapeutic and preventive) nutrition, individual and collective protective equipment in accordance with the norms established by the authorized state labor authority;
Do not allow employees under eighteen years of age to carry and move weights exceeding the established limits;
Do not allow women to manually lift and move weights exceeding the established limits;
Register, record, and analyze accidents related to labor activity and occupational diseases;
Provide the authorized state labor authority and local labor inspection authority with necessary information for monitoring working conditions, safety, and labor protection, at least once every three months, and to representatives of employees upon their written request;
Conduct investigations into accidents related to labor activity, according to the procedure established by the legislation of the Republic of Kazakhstan;
Comply with the instructions and conclusions of state labor inspectors;
Conduct periodic labor conditions certification of production facilities with the participation of employee representatives, in accordance with the rules approved by the authorized state labor authority, at least once every five years;
Insure employees against accidents while performing their labor (service) duties and provide information to the authorized state labor authority about the conclusion of the mandatory insurance contract against accidents while performing labor (service) duties, according to the procedure defined by the authorized state labor authority;
Take immediate measures to prevent the development of emergency situations and the impact of harmful factors on others;
Develop, approve, and revise safety and labor protection instructions in accordance with the procedure established by the authorized state labor authority;
Conduct mandatory, periodic (throughout employment) medical examinations and pre-shift medical examinations at your own expense, in cases provided by agreements, collective agreements, the legislation of the Republic of Kazakhstan, and also when transferring to other work with changes in labor conditions or the appearance of signs of occupational disease;
Implement an occupational safety management system and monitor its functioning.
